Overview
These Terms of Service ("Terms") govern your use of the websites museoptic.ca and musevision.ca and all related products and services (the "Services"), which are operated by MUSE VISION & EYEWEAR GROUP INC., doing business as Musee Optical Studio ("we", "us", "our"). By using the Services or placing an order, you agree to these Terms and our Privacy Policy. These Terms do not limit any rights you have under applicable consumer protection laws.

1. Eligibility and Accounts
You must be at least the age of majority in your province or territory of residence to place an order. Orders for minors must be placed by a parent or legal guardian. You agree to provide accurate, current, and complete information and are responsible for keeping your account credentials secure.

2. Prescriptions and Health Information
Prescription eyeglasses and contact lenses are sold only on the basis of a valid, unexpired prescription issued by a licensed eye care practitioner. You are responsible for the accuracy of the prescription and measurements you provide. We may contact you or your practitioner to verify a prescription, and we may decline or cancel any order we cannot verify. Online tools on our websites, including measurement and advisory tools, are provided for convenience and do not replace a comprehensive eye examination. If you experience eye pain, redness, or changes in vision, stop wearing your lenses and consult an eye care professional promptly.

3. Products
We make every effort to display our products accurately, but colours and appearance may vary depending on your screen. Product descriptions, availability, and prices may change without notice. We may limit quantities or discontinue products at any time.

4. Orders
Placing an order is an offer to purchase. Your order is accepted only when we confirm it and receive payment. We may decline or cancel any order, including for pricing errors, suspected fraud, or an unverifiable prescription; if we cancel after payment, we will refund you in full. Returns and exchanges are governed by our Return and Refund Policy.

5. Prices and Payment
Prices are in Canadian dollars and exclude applicable taxes and shipping unless stated otherwise. The price charged is the price in effect when your order is placed. You confirm that you are authorized to use the payment method you provide.

6. Shipping
Delivery times are estimates only. Title and risk of loss pass to you when the product is delivered to the carrier, except where applicable law provides otherwise. See our Shipping Policy for details.

7. Intellectual Property
All content on the Services, including text, logos, graphics, images, and product listings, is owned by or licensed to MUSE VISION & EYEWEAR GROUP INC. and is protected by Canadian and international copyright, trademark, and other intellectual property laws. You may use the Services for personal, non-commercial purposes only, and may not copy, reproduce, modify, distribute, or republish any content without our prior written consent. The Musee Optical Studio name and logos are trademarks of MUSE VISION & EYEWEAR GROUP INC. Third-party brand names, including those of eyewear and lens manufacturers, are trademarks of their respective owners. All rights not expressly granted are reserved.

8. Third-Party Tools and Links
The Services may include third-party tools or links to third-party websites, which we do not control. Your use of them is at your own risk and subject to their terms.

9. Relationship with Shopify
Our online store is powered by Shopify. All sales are made directly with MUSE VISION & EYEWEAR GROUP INC. Shopify is not responsible for any aspect of those sales. Shopify collects and processes information about your use of the store as described in our Privacy Policy and Shopify's privacy policy.

10. Reviews and Feedback
If you submit reviews, comments, or feedback, you grant us a non-exclusive, royalty-free, perpetual licence to use, reproduce, and publish it in connection with the Services. You confirm that your submissions are your own, are accurate, and do not violate any law or third-party rights. We may remove any submission at our discretion.

11. Prohibited Uses
You may not use the Services for any unlawful purpose; to infringe intellectual property rights; to transmit false, harmful, or malicious content; to collect others' personal information; to interfere with security features; or to access the Services using automated tools, bots, scrapers, or AI agents without our written permission.

12. Errors and Omissions
Information on the Services may occasionally contain errors in descriptions, pricing, or availability. We reserve the right to correct errors and to update or cancel orders affected by them, with a full refund of any amount paid.

13. Disclaimer of Warranties
Except as expressly stated by us or required by law, the Services and products are provided "as is" and "as available", without warranties of any kind, express or implied. Some jurisdictions do not allow certain warranty exclusions, so these may not apply to you.

14. Limitation of Liability
To the fullest extent permitted by law, MUSE VISION & EYEWEAR GROUP INC., its directors, officers, employees, and agents will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Services or any product. Our total liability for any claim will not exceed the amount you paid for the product giving rise to the claim. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

15. Indemnification
You agree to indemnify MUSE VISION & EYEWEAR GROUP INC. and its affiliates against claims arising from your breach of these Terms or your violation of any law or third-party rights.

16. Termination
We may suspend or terminate your access to the Services at any time if you breach these Terms.

17. Governing Law
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein. You agree to the jurisdiction of the courts of British Columbia, without limiting any right you may have to bring a claim in the courts of your province of residence under applicable consumer protection law.

18. General
If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. Our failure to enforce any provision is not a waiver. These Terms, together with our posted policies, are the entire agreement between you and us regarding the Services. In case of conflict between an English version and a translated version, the English version prevails.

19. Changes
We may update these Terms by posting a revised version on this page. Changes apply to orders placed after the update is posted.
